I. General Provisions

  1. This Privacy Policy defines how personal data of Users, necessary to provide electronic services via the website www.takom.pl (hereinafter: the Service), is collected, processed, and stored.
  2. The Service collects only personal data necessary for the provision and development of the services offered therein.
  3. Personal data collected via the Service is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation, GDPR), and the Polish Personal Data Protection Act of 10 May 2018.

III. Purpose of Personal Data Collection

  1. Personal data is used for the following purposes:
    • creating and verifying a User account,
    • execution of service agreements,
    • communication with the User (live chat, contact form, etc.),
    • sending newsletters (with User consent),
    • managing the comments system,
    • providing community services,
    • promoting the Controller’s services,
    • marketing, remarketing, affiliation,
    • personalizing the Service for Users,
    • analytics and statistics,
    • establishing and pursuing claims or defending against them.
  2. Providing data is voluntary but necessary to conclude an agreement or use other functionalities of the Service.

IV. Types of Processed Personal Data

The Controller may process the following personal data: name and surname, date of birth, address of residence, email address, phone number, and tax identification number (NIP).

V. Data Retention Period

Personal data will be processed for the following periods:

  • if the basis is contract performance – until the limitation period expires after the contract is completed,
  • if the basis is consent – until consent is withdrawn, and after withdrawal, until the limitation period expires.

In both cases, the limitation period is 6 years, or 3 years for claims related to periodic benefits or business activities (unless otherwise provided by law).

VI. Data Sharing

  1. User data may be shared with entities related to the Controller, subcontractors, and entities cooperating with the Controller, such as payment service providers, courier/postal companies, and legal offices.
  2. User data will not be transferred outside the European Economic Area (EEA).

VII. User Rights

The User has the right to:

  1. access their personal data,
  2. rectify, delete or restrict processing of their data,
  3. data portability,
  4. object to data processing,
  5. withdraw consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal).

The Controller will fulfill or deny the request without undue delay – within one month at the latest.
The User has the right to lodge a complaint with the President of the Personal Data Protection Office (UODO) if they believe their rights under GDPR are being violated.

VIII. Cookies

  1. The Service collects information via cookies – session, persistent, and third-party cookies.
  2. Cookies help ensure proper service functionality and are used for statistical purposes.
  3. Users can define the scope of cookie access to their device via browser settings.

IX. Automated Decision-Making and Profiling

  1. User data is not subject to automated decision-making that could result in legal effects for the User.
  2. User data may be profiled for content customization and offer personalization, only with the User’s consent.

X. Final Provisions

  1. The Controller reserves the right to modify this Privacy Policy, without limiting User rights.
  2. Any changes will be communicated via an update notice available on the Service.
  3. Matters not regulated by this Privacy Policy are subject to the provisions of the GDPR and applicable Polish law.
